Want to run a restaurant in China? Business license is not enough!

There are always kinds of specialty food in different countries and regions. There is no national boundary for the love of food. Especially in Guangzhou, which is known as the "City of Gastronomy", there are not only many local cuisines, but also diverse foreign cuisines.


However, it is not so simple to run a restaurant or catering company here. We all know that a business license is necessary for starting business, but in the catering industry, you also need to apply for a Food Business License.


Food Business License

In China, the business scope of registered market entities is divided into general business items and licensed business items. Entrepreneurs do not need to get approval or get filed for general items, only need a business license; but the licensed items can only be formally operated after obtaining the approval of relevant departments.


Licensed business items:


(1) Engaged in the sales and production of medical devices (excluding Class I medical devices) and drugs

(2) Engaged in the retail and printing of books, newspapers, periodicals and publications

(3) Engaged in the sales of audio and video products

(4) Engaged in liquor retail and wholesale

(5) Establishment of medical institutions

(6) Engaged in food circulation

(7) Engaged in tobacco retail and wholesale

(8) Catering

(9) Engaged in hotels and guest rooms

(10)Engaged in road transportation and surface transportation



Therefore, operators engaged in food sales, unit canteens or catering services need to apply for a Food Business License to carry out their business legally.


For those who engage in food business without obtaining food business license, the local food and drug supervision and administration departments at or above the county level shall confiscate the illegal income, illegal food, tools, equipment, raw materials and other articles used for illegal production and operation.


If the value of food illegally produced or marketed is less than 10000 yuan, a fine of not less than 50000 yuan but not more than 100000 yuan shall also be imposed; If the value of the goods is more than 10000 yuan, a fine of not less than 10 times but not more than 20 times the value of the goods shall also be imposed.


The food business license can be divided into the following three categories according to the business type of the business entity: food operators, catering service providers and unit canteens.


*For the sale of prepackaged food only, it is not required to obtain a license. Instead, it is only necessary to submit online to the food safety supervision and administration department at or above the county level for filing, and the sale can begin after the approval.


In addition, the validity of the Food Business License is 5 years. If it needs to be extended, an application for extension shall be submitted 30 days before the expiration of the validity.
